I saw the doc great work and thanks for putting in teh effort.
So in layman terms can you please explain, how many EB3 visas are allocated per month or per year and how many are necessary as per your doc, that will atleast help us understand how slow its gonna move,
are we talking about 15 days in one visa bulletin movement for EB3 or 30 days (1month) movement in one visa bulletin.
If we can do this , then we can predict how long it would take?

According to my own experience, all is about credit histories and credit scores. If you have not lived long enough in the US (3 years or more might be enough), you don't have a credit history or you have one but it is insufficient, and financial institutions, mortgage companies, car insurance companies, etc, don't know you, consequently, everything is expensive for you: high car insurance premiums, high mortgage rates, high premium for homeowner insurance...if only they except to do business with you. (By the way, I was denied a credit card, a car insurance...when I first moved to Arizona in 2001; fortunately I was able to keep using anything that was Canadian: car and car insurance, credit card, bank account, etc.). Otherwise you are denied everything. I am talking about my own experience as Canadian Citizen working in the US under H1-B before 9/11 event. It must be harder nowadays.
Now financial institutions know me, I receive tons and tons of credit card and mortgage offers...and I had to go to this website https://www.optoutprescreen.com/?rf=tto opt-out, so I don't get those ads anymore.

i think gc_maine2 has a valid question...especially if you use H1 transfer (6-9 years) for the new employer and not EAD

Person X has completed 180 days after 485 filing, used is 6 yrs of H1 and now he got a 3 yrs of H1B from the same employer. If this person uses AC21 & EAD and joins another company and after 1 yr his 485 is rejected for wrong reasons, will this person be out of status(since used EAD) or will be in status since his H1b is still valid with the old employer (Assumed the employer has not revoked). Will it be safe to come back to the same employer.

Guys, please take attorney advise before rushing in to refile. Duplicate applications may create problems for you later on.
Imagine, given the huge retrogression how many countless times we will be refiling our EADs ad APs if we don't act now.
Many people are blissfully enjoying the fruits of labor of some very dedicated IV member who selflessly participated in San Jose rally and flower campaign. These efforts were instrumental in the July visa bulletin reversal. Isn't it time we all stood up for our rights and make a strategic impact through a legislative change rather then just be satisfied with a tactical July visa bulletin reversal win?
I can't talk enough about how vital it is for you to act now. Presidential race will kick in after October/ November time frame. Our window of opportunity is short. Lets help ourselves!

Firstly, I'm a supporter of CIR...but I still sense some ambiguity in these lines...
may be it's just me...:)

The specific details is what we are all waiting for. CIR seems to be the only way to expect some change for EB. We need to work for this change to be a good one for us.

I'm posting this here since the old volunteer forums are no longer available. Where all have you posted flyers, info in CA?
For those in the Bay Area: Have you contacted the new Indian Community Center in http://indiacc.org/Default.aspx (they have locations in Milpitas and Sunnyvale)? I don't live in the South Bay, but it seems like this is a pretty active space. Wonder if they would let us give a talk, and/or post flyers etc. If no one has been in touch with them, I could try.

Thanks KS !! but is it a law or did they create their own rules ? I know I am day dreaming here ...but if they were to push (the worst category) EB3 - I in this case so that it is somewhere in 2003 then it would make their system look better ..i.e. instead of giving people a chance to say that USCIS is broken they could say ..people will get GC's in 4 -5 years time.
Check the Family based 4th Category for Phillipines. It is stuck in 1986 for a long time now. That is they have pending applications from 22 years ago.

Your case is a bit different, I am not sure if you could avoid paying back as GC process is for your benefit so a company could request a pay-back, even though amount is a bit high and you did not get anything in return. I would compare it to a situation where company gives an employee a laptop and expect person to return it when s/he leaves a company.
helloh1's clause is different - company receives benefits by training its employees so it's just plain wrong to request a pay back in that case.
So just forget about it and move on, we all make mistakes and here in the US those mistakes usually cost money.

Negative testimony can be used by some to harp on issues or get some leverage. However let the truth be there. Not everyone will be happy with legal immigration reform. I filed I485 and my I140 got cleared. My employer is not willing to give my Approved I140. I am not sure why he is holding my I140. I dont have have any idea to change job at this time.

What I don't understand is it's not mandatory to inform the USCIS about moving to a different job via AC-21. If you are not required to inform them, then where does the question of AC-21 approval arise ?
